James P. Hoffa has received a majority of valid votes cast in the election for General President of the Teamsters Union, according to ibtvote.org, the official website for the Office of the Election Supervisor for the International Brotherhood of Teamsters. The counting of ballots was completed on November 18, 2016, but the results will not be official until certified by the Election Supervisor, Richard W. Mark. If certified, this will be Hoffaâs fourth reelection win. The last election was held in 2011.

Earlier today, Judge Mazzant of Eastern District of Texas issued an order granting the request of 20 states for a nationwide preliminary injunction blocking the Obama administration's new rule raising the minimum salary for the FLSA white collar overtime exemptions to over $47,000. The rule was scheduled to take effect next week on December 1. In enjoining the rule, the court found that the states had demonstrated a likelihood of prevailing on the merits of their lawsuit and had shown that irreparable harm would result if the rule was not blocked immediately. In so ruling, the court found that the rule was unlawful and exceeded the authority of the Department of Labor. With the court's ruling, the new overtime rule is temporarily blocked on a nationwide basis pending final disposition of the litigation (and/or reversal of the order following review on any appeal). The case is State of Nevada, et al v. United States Department of Labor and is pending in the Eastern District of Texas.

Executive Summary: Employers do not have to make changes to comply with the Department of Laborâs (DOLâs) new overtime regulations by the December 1, 2016 deadline. In a surprising decision, a federal District Court in Texas issued an injunction halting the implementation of the new overtime rules nationwide. If the injunction remains intact when President-elect Trump takes office, it may allow the new administration additional avenues in which to seek to modify, amend or repeal the DOLâs overtime rule, even if further judicial action is not taken to ultimately overturn the regulations.

New York Mayor Bill de Blasio is engaged in a flurry of pre-election actions.1 Most recently, he signed Executive Order 21, which prohibits New York City agencies from asking prospective employees about their salary history before making an offer of employment. The order will take effect on December 4, 2016. It is aimed at bridging the wage gap for women and people of color, groups who are often paid less than white males for substantially similar work. The Order prohibits inquiries about a job applicantâs prior wages, salaries, benefits, or other compensation. A prospective employer may only make inquiries about previous salaries after the employer has extended the applicant a job offer with pay information.

On Oct. 24, 2016, a New York court ruled that the stateâs Not-for-Profit Corporation Law (âN-PCLâ), as amended by the Nonprofit Revitalization Act of 2013 (the âActâ), contains an implied private right of action for failing to protect whistleblowers from retaliation. The Supreme Court, Kings County rejected the notion that the Actâs âWhistleblower Policyâ requirement only permits the attorney general or the board of directors to file suit and ruled that the Act implies a private right of action.
